Family Court Records in Rains County

Rains County family court records cover all family law cases filed in the district court. The most common type is divorce. A divorce case file includes the original petition, any response from the other party, temporary orders, and the Final Decree of Divorce. The decree spells out how property is split, who has custody of the children, the possession schedule, and any support obligations. These documents are public record in Texas unless a court has sealed them.

Child custody cases may be filed independently of divorce under Texas Family Code Chapter 153. The court uses a conservatorship framework. One parent is typically named as the managing conservator with primary rights. The other parent generally receives possessory conservatorship with a set visit schedule. The judge's primary concern in all custody matters is the best interest of the child.

Child support is part of most cases where children are involved. Texas Family Code Chapter 154 sets the rules for how courts calculate support amounts. Paternity cases, protective orders, and modification requests also run through the district court and become part of the family court records kept by the Rains County District Clerk.

Filing for Divorce or Family Court in Rains County

To file for divorce in Rains County, you must meet Texas residency requirements. Texas Family Code Section 6.301 requires that at least one spouse has lived in Texas for six months and in Rains County for 90 days before you file. Once you meet those requirements, file the Original Petition for Divorce with the District Clerk at the courthouse annex in Emory. At the time of filing, you will also need to submit a Civil Case Information Sheet.

After filing, Texas law imposes a 60-day waiting period before a divorce can be finalized. Texas Family Code Section 6.702 establishes this rule. The countdown starts on the day you file. If there is a history of family violence, the court can waive the waiting period. Once it expires, if both parties agree on everything, the case can move quickly to a final hearing.

The other spouse must be formally served with the divorce papers after you file. Service can be done by a constable, sheriff, or process server. If the other party agrees not to contest, they can sign a Waiver of Service instead. After service, they have time to file a written response. If they do not respond, the case may proceed as a default.

Court forms for family law cases in Rains County are available at the clerk's office and online. The Texas State Law Library has family law form packets. Self-help resources are at txcourts.gov/programs-services/self-help. If you cannot afford the filing fee, ask about filing a Statement of Inability to Afford Payment of Court Costs under Texas Rule of Civil Procedure 145.
